Terms & Conditions

CHARTER INCLUSIONS

These Terms and Conditions govern all bookings and services provided by Superfly

Concierge LLC, hereafter referred to as the “Booking Agent”, and any customer,

hereafter referred to as the “Client”.

 

By confirming a booking, making payment, or participating in any service provided

by the Booking Agent, the Client acknowledges that they have read, understood,

and fully agreed to all Terms and Conditions stated herein.

 

1. General

1. Any dispute or claim arising out of or in connection with services provided

by the Booking Agent shall be governed and construed in accordance with

the laws of the United Arab Emirates (UAE).

 

2. Minors under the age of 18 are prohibited from making bookings or

entering into contracts with the Booking Agent.

 

3. Clients who make a payment for our products or services on our website or

via payment link, the details you are asked to submit will be provided

directly to our payment provider via a secured connection. The cardholder

must retain a copy of transaction records and Merchant policies and rules.

 

2. Payments & Booking Confirmation

1. A booking is confirmed only once a deposit payment has been received.

 

2. The client acknowledges that yacht charter bookings reserve a specific

vessel, crew, and time slot which becomes unavailable to other clients

once confirmed.

 

3. Due to the nature of reserving a time-specific service, all deposits are

strictly non-refundable.

 

4. Full Payment (100%) must be completed prior to the scheduled charter

departure.

 

5. In compliance with UAE maritime regulations, the Client must provide valid

identification prior to departure.

Acceptable identification includes:

  • Passport

  • Emirates ID

  • UAE Driving License

 

3. Strict No Refund - Reschedule Only Policy

1. All deposits and payments made to the Booking Agent are final, and strictly

non-refundable. In the event of unforeseen circumstances or force

majeure, bookings may be rescheduled to a later available date.

2. By confirming a booking, the Client acknowledges that they are purchasing a

reserved time slot for a charter service which cannot be resold once secured.

3. Refunds shall not be issued for any reason including but not limited to:

  • Client cancellation

  • Failure to attend

  • Late arrival

  • Illness

  • Personal emergencies

  • Travel distruptions

  • Visa issues

  • Airline cancellations

  • Missed flights

  • Change of plans

 

The sole remedy available, if any, shall be rescheduling, granted strictly at the sole

discretion of the Booking Agent and subject to availability.

 

4. Rescheduled bookings must be utilized within a timeframe mutually agreed

upon by both parties from the original booking date, unless otherwise

confirmed in writing.

 

5. The deposit may be transferred to another person, subject to prior notice and

approval.

 

4. Government Maritime Authority & Weather Restrictions

If sailing is restricted or suspended by:

Dubai Coast Guard, Dubai Maritime Authority, Port Authorities

Government Directives, Safety Including but not limited to weather conditions, sea safety concerns, port closures,

or operational restrictions:

  • The booking will be rescheduled to the next available suitable date.

  • No refunds will be issued, as such restrictions are beyond the control of

both Superfly Concierge LLC and the yacht provider.

  • Rescheduling shall be the sole remedy available to the Client.

 

5. International Travel Disruptions

For Clients traveling from outside the UAE:

1. Travel disruptions including airline cancellations, missed flights, visa issues,

delayed flights, or personal travel complications do not qualify for refunds.

 

2. In the rare event of an official government-mandated full airport closure that

legally prevents entry into or exit from the UAE, the Booking Agent may

review the case.

 

3. Any refund consideration remains entirely at the sole discretion of the

Booking Agent.

 

6. Force Majeure

The Booking Agent shall not be liable for failure or delay in performance resulting

from events beyond its reasonable control, including but not limited to:

  • Acts of God

  • Extreme weather

  • War

  • Pandemics

  • Natural disasters

  • Port closures

  • Government restrictions

  • Maritime authority decisions

  • Coast Guard suspension

 

In such circumstances, bookings may be rescheduled where possible. Refunds

shall not apply.

 

7. Chargeback & Payment Dispute

1. By making payment, the Client confirms they are the authorized cardholder

or have authorization from the cardholder.

 

2. Any fraudulent chargeback attempt, including false claims may result in legal

proceedings and recovery action.

 

3. Jurisdiction for all disputes shall be exclusively within the courts of the United

Arab Emirates.

 

8. Liability Disclaimer

1. Participation in yacht charters is undertaken entirely at the Client’s own risk.

 

2. The Booking Agent shall not be liable for injury, loss, damage, theft, delay,

accident, or claim of any nature.

 

3. The Client agrees to release and hold harmless the Booking Agent from any

liability arising from participation in the booking.

 

9. Photography & Media

1. The Booking Agent reserves the right to capture photographs and video

footage during charters for promotional and marketing purposes.

 

2. By confirming a booking, the Client grants permission for such material to be

used for marketing and promotional use.

 

3. Clients who do not wish to appear in such material must notify the Booking

Agent in writing prior to the charter date.

 

10. Conduct & UAE Law Compliance

1. Clients must respect UAE cultural, legal and religious standards.

2. Prohibited conduct includes but is not limited to:

  • Disorderly behaviour

  • Illegal substances

  • Nudity

  • Public indecency

  • Profanity

  • Illegal activities

  • Failure to comply with the yacht captain’s instructions and

onboard safety rules

 

3. Music may be paused during prayer times in accordance with UAE

regulations.

 

4. During Ramadan, Clients must comply with applicable UAE regulations

regarding food and drink while in harbour.

 

5. The Booking Agent reserves the right to terminate a booking without refund

if inappropriate or unlawful behaviour occurs.

 

11. Acceptance of Terms

By confirming a booking, making payment, or participating in any service provided

by Superfly Concierge LLC, the Client acknowledges that:

They have read and fully understood, and irrevocably agreed to all these Terms

and Conditions.

They accept that this document constitutes a legally binding agreement.

No verbal statements or prior communications shall override or amend any part of

these Terms unless confirmed in writing by Superfly Concierge LLC.
